日本の「国際化」教育に潜む閉鎖性の問題

 SNSで国の内外を問わず驚くほどの人脈を四方にもち、それに呼応する情報ネットワークの大きさを基に、精力的に日本の国内の出来事を外の世界で起きていることに関連付けてピリッとした味のある批評を繰り広げているKaori FTという人がいます。このKaori FT氏が次のような〝つぶやき″を最近投稿しました。 

  <riot against refugees とグーグルに検索入れれば、ヒットがAbout 1,320,000    results (0.32 seconds) ある。日本語で>難民に対する暴動と入れれば、About 247,000 results (0.46 seconds)と出てくる。

         <ニュースの差はヒット数の差と比例するのは当然か>

 

ニュースにしても特定の出来事に関する情報量が少ないということは、日本国内でそのことに対する関心が薄いということであり、日本の外の世界で起きている出来事、良いものであれば、共に歓喜する心、不幸な出来事であれば、それに対して惻隠の情を示すということが欠けているのです。この上に引用した短いひとことに滲み出ることは、その思考様式の基にある視野の広さです。私がKaori FT氏の批評に敬意を表するのは、単に、話題とする関心事の多彩で豊富なことだけではなく、その多岐にわたる問題意識の中にブレもせずに貫かれているグローバルな視界です。日本という一国の「自己完結的な閉鎖的社会」からの見方ではなく、そに開かれた思考により、日本を世界の中で捉えていく、という姿勢です。

 1964年の「東京オリンピック」を契機にして以来、日本の「国際化」が叫ばれてきましたが、半世紀もたった現在でも同じように、いやそれ以上に「国際化」の必要性が求められています。換言すれば、半世紀にわたる「国際化」教育というものがそれほどの期待された結果を出さずにいるという冷酷な現実があるのです。本稿では、その日本での「国際化」教育と言われるものが持つ基本的な「閉鎖性」の問題を取り上げたい、と考えます。

 

I.

 昨年(2015年)春以降繰り広げられた安保法制案の議論でも明らかになったように、日本の「一国平和主義」も、基本的には日本とその外の世界との関係が断続しているのです。 日本の ニュースの差はヒット数の差と比例するのは当然か 刑法には、犯罪行為の違法性を阻却する事由として、「急迫不正の侵害に対して、自己又は他人の権利を防衛するため、やむを得ずにした行為は、罰しない」と「正当防衛」(第36条)として自衛権を定め、さらに、「自己又は他人の生命、身体、自由又は財産に対する現在の危機を避けるため、やむを得ずにした行為は、これによって生じた害が避けようとした害の程度を越えなかった場合に限り、罰しない。ただし、その程度を超えた行為は、情状により、その刑を減軽し、または免除することができる」と「緊急避難」(第37条)という自力救済が認められています。その自衛の行動にしろ緊急避難にしろ、その行動の主体としての「自己」という概念には、単に個別的な「自己」のみならず、第三者である「他人」をも包容する自己の利益と他人の利益とを一体化した概念である「集団的自己」を認めているのです。

 一人の人間が他人と共に危機感を共有して一体化するからこそ、惻隠の情に動かされて自己以外の他人の利益の防衛・保護をするために行動をする、という概念です。昨今の集団的自衛権の行使にまつわる議論を聴いておりますと、いったい、いつからこのような「惻隠の情」は日本人同士間のみに適用されるものになってきたのでしょうか。つまり、日本国の刑法であっても、国内の出来事であっても、日本人は、外国人、つまり非日本人、が危険にさらされている時には、「君子危うきに近寄らず」と決めつけ、見て見ぬふりをして通り過ぎるのでしょうか。それとも、襲われたものが日本人であれば、「義を見てせざるは勇無きなり」と奮起して「同胞」を救済するために一肌脱ぐのでしょうか。それとも襲い掛かった者が同じ日本人であれば、「拘りあうのは御免だよ。ほっとけ、ほっとけ」と言って立ち去るのでしょうか。

 「義を見てせざるは勇無きなり」として行動を起こすか、「君子危うきに近寄らず」として知らん振りをするか、という、作為、不作為は別にしても、法的には、日本の刑法は「集団的自己」という考概念を認めている、という事実があるのです。それなのに、なぜ、国際社会の問題になると、この国内的に認められている概念が否定されるのでしょうか。なぜ国際法として、実定法でも、慣習法でも、確立している集団的自衛権の意味が日本の社会に入ると日本だけで通用する「日本版集団的自衛権」になってしまうのでしょうか。

 

 II.

 歴史学碩学岡田英弘先生によると、学校で習う日本の歴史の教え方に問題があるということです。なぜかと言えば「今の日本の歴史教科は日本史と世界史に分かれているが、この区分が示しているように、日本は世界の中にではなく、世界の外の宇宙空間にある。逆に言えば、世界は日本の外の宇宙空間にある。日本の歴史は日本の歴史だけ、世界の歴史は世界の歴史だけで、日本と世界は完全に断絶している」からであると断言しています。歴史を教える人も、国際法を教える人も、同じように全世界的な視野から日本を見ていないのです。 その結果、「世界の中での日本の位置(列強の中でのランクではなく)は考えてもみず、あくまでも自己完結的な、閉鎖的な日本という小さな宇宙の内部での瑣末的な詮索と論評に終始している」からだといいます。

 岡田氏によると、このような物の見方をするようになったのは、日本という国と文化が七世紀後半の唐をめぐる対外関係の大変動の衝撃から作り出されてきた国であり文化であったからなのです。したがって、「日本列島を外からの脅威に対して防衛することが国家の最重要課題であり、鎖国こそ日本の国是だったのである」、と説いています。

 ここでは、和辻哲郎の名著『鎖国―日本の悲劇』にならんで、「鎖国」を「国を鎖(と)ざす行動」を意味するものとして、「鎖(と)ざされた国の状態」を指すものではないことにします。

 ただし、そもそも、「鎖国」という言葉自体が、江戸時代18世紀後半に長崎で蘭学者で通詞として身を立てていた志筑(しづき)忠雄が、1690年から92年の間オランダ東インド会社の長崎の商館で医師として勤務していたドイツ人医師、エンゲルベルト・ケンペルが上梓した1733年のオランダ語第2版『日本誌』の中に収められている一章を訳して「鎖国論」と1801年になずけたのが始まりであって、それ以前に「鎖国」という言葉が使われたことは一切なかったのです。いわゆる「鎖国令」なども正式な名称ではなく、後に歴史家が、1633年と1634年の奉書船以外の交易の禁止令、1635年の日本船の海外渡航及び帰国の禁止令、1636年の非交易関係者ポルトガル人のマカオ追放令、1639年のポルトガル船の来航禁止令という五回に亘って発令されてた一連の「禁止令」の総称として名付けたものなのです。これにより、ポルトガルやスペインの植民地政策の伏兵としてのキリシタン宣教師を排除し、大村純忠高山右近に代表されるキリシタン大名を追放することにより、ポルトガルやスペインからの軍事干渉が発生する可能性を排除する政策の一環であったのです。と同時に、このいわゆる「鎖国」政策は、九州諸藩の対外交易(特にオランダ)との通商を長崎に限定して、それを徳川家で独占することにより、他の大名が外国勢力と関係を 作らないようにする目的があったのです。

 この「鎖国」政策の対象はヨーロッパ諸国だったのです。徳川幕府はすでに当時の「国際関係」を把握するのに必要な三つの窓口、薩摩藩琉球を通じての明との交易(薩摩口)、対馬藩の宗氏を通じての李氏朝鮮との交易(対馬口)、松前藩を通じての蝦夷地・樺太アイヌとの交易(松前口)ルートを押さえていたのです。ただし、今までの三つの口とは異なり、西洋の宗教、航海術、造船技術、大砲、火薬などの製造の知識と技術を幕府の利益を損なうことのないようにいかに「管理」するか、ということに配慮をしたのです。そのために、長崎という幕府直轄地に四つ目の口「出島」を設けて、ヨーロッパとの交易・知識・技術の渡来を幕府の直接管理の許においたのです。これは豊臣秀吉が1587年に出した第一回目のバテレン追放令(伴天連追放令)から始まり1639年のポルトガル船来港禁止令に至るまで52年もの年月を費やしていたことが如実に語っています。

 松方冬子氏は『オランダ風説書』中公新書(2010年)の中で、「キリシタン禁制のためヨーロッパ人の入国を制限して監督し、同時にそれまで九州全域で行われていた唐船との貿易を一括して管理するという幕府政策の大きな流れの中で、長崎は生まれた」という認識の下に、「幕府が危険視したのは、ヨーロッパの思想(キリスト教)や軍事力である」と言い,「『四つの口』がどちらかと云うと[日本が国交をもたない]中国と『つながる』ための装置だったのに対し、『鎖国』政策はヨーロッパ勢力から身を『まもる』ためのものであり『仮想敵』を持っていたのだ」と主張しているのです。

 このように、「鎖国」という言葉から連想される状況とは別に、実際は国を閉ざすどころか東アジア諸国との交流は密接に存在していたし、松前藩蝦夷地へ、対馬藩は朝鮮へ、薩摩藩琉球へ、それぞれ渡航が認められていたのです。これらの「三つの口」では、日本人および外国人双方とも出入りが可能であったのです。そもそも、外国との関係をもつ港をある一定の場所に限定することは極普通なことなのです。現在でも、海外からの航空機・船舶は出入国管理、税関、検疫などの業務執行が可能な都市にある国際空港や港湾に限られいるのは当然なことで、これを以て「鎖国」などという人は誰もいません。「四つ目の口」長崎が特異なのは、その港は既存の「三つの口」の対象以外の外国人のみが出入り出来ても日本人が出て行くことが禁止されていたという一方通行的であったことなのです。ただし外からの情報は確かに入ってきたのです。そうであれば、和辻哲郎大東亜戦争における敗北によるショックからその敗因を「日本の悲劇」として「科学的精神の欠如」として著した『鎖国』にあるくだり、「鎖国が問題になるのは世界的な交通が始まったからであって、一つの世界への動きはすでにそこに見られる。鎖国とは一つの世界への動きを拒む態度である」という主張は正しいのでしょうか。

 もちろん、織田信長も、豊臣秀吉も、徳川家光も、キリシタンの宗教的教義というよりも、領地の保全、統治組織の独立に対する干渉・脅威がなかったならば、経済的・文化的な交易は継続していたのでは、と考えます。ただ、岡田氏の言っていることは島国日本の外からの侵略に対する自衛としての必要性が「閉鎖的な性格」を基本的に生み出した、ということは否定できないのでしょう。250年も続いた「鎖国」の影響とは、和辻哲郎が言うように実際に「国民の性格や文化のすみずみにまで及んでいる」のでしょうか。   

 

III. 

 倭寇から始まり勘合符貿易を経て朱印船貿易に至るプロセスは、「私人」としての個人の集団がそれぞれの個性、気概、器量と財力をもとに外に活動の場を求めていったときに、その実利を目にし、支配者側がその実利を占有するための施策をとるという状況との間を行ったり来たりするようなものでした。それでも、支配者側には、「私」の集団の活動を黙認するか、逆に、支配者側の統治組織の維持・拡大のための収入源として海外通商活動から一定の税を徴収するという違いはあっても、あえて「公」の支配者側から積極的な支援を「私」の集団に差し伸べるとか、あるいは、「公」の方針として海外活動を計画し援助するということはなかったのです。もちろん、勘合符とか朱印状を与えるということは、「公」の支援といえるものですが、それは交易の相手側に対して当該交易者は倭寇などの海賊ではなく「公」に承認されている交易者である、という便宜と安全通航を与えていたわけです。つまり、交易相手国の保護を依頼していることと同じなのでした。これは、外国からの倭寇に対する苦情を処理するための「対倭寇対策」の一環であって、積極的に対外交易を重視してその発展を支援・促進するための理解と政策ではなかったのです。

 とは言うものの、対外交易は盛んに営まれ、17世紀初めまで富と情報・知識の取得と蓄積に多大な貢献をしてきたのです。ここで覚えておかなければならない大事なことは、徳川家光により「鎖国令」が敷かれ、後に「祖法」とまで言われた限定された‶対外関係維持規範″ともいえるものに依り「通信・通商」関係を清、朝鮮、琉球、オランダの四か国に限定した以前までは、朱印船貿易南シナ海沿岸地域の国々を対象に交易が成り立っていたのです。祖法となった「鎖国」体制の下でも、オランダの商館を通じての毎年恒例の参府が行われていたし、そのたびに、「オランダ商館風説書」の提出が求められていたのです。したがって、外からの新しい情報・知識の取得には、時間的な遅延があったとしても、それほど困らずにいた、ということです。1690年から92年に亘り長崎のオランダ商館で勤務したドイツ人医師ケンペルが当時に日本における西洋医学の普及度を明らかにしています。ということは、和辻哲郎の主張のように「科学的精神の欠如」をすべて「鎖国」に負わせることには少し無理がある、と考えます。では、どこにヨーロッパのいわゆる「先進国」と日本との自分の社会の「外」の世界に対する考え方に違いが出てくるのでしょうか。 

 外に出るということは、「私」個人一人では限度があります。海外で、グローバルな活動を可能にするだけの組織力とその組織が持つ支援の補給力を与えてくれるものが日本という国家の存在であって、日本社会全体の活力なのです。 それが統治機構が執る政策を支えていく総体的な国力なのです。残念ながら、日本では、ほかの人と違ったことをする者は「変人」であり、世間の「常識」をわきまえない者なのです。極端に言えば、「異端者」という烙印を押されるのでした。まさに、倭寇和辻哲郎が言うように「北九州や瀬戸内海沿岸の『あぶれ者』ども」が14世紀半ばに、鎌倉幕府の崩壊とその後の内乱が引き起こした生活の困難によって「押し出」されたのです。小学館の『日本国語大辞典第二版』によると、「あぶれ者」は次のように定義されています。「① 無頼で、持て余されているもの。ならず者。ごろつき。」とまずあり、次に、「② 仕事にありつけない者。失業者。浮浪者。」とあります。さらに、「あぶれる」には「① 水などがいっぱいになってこぼれる」に始まり、「② こぼれるかと思われる程にいっぱいになる。また、感情や才気などがいっぱいに満ちている」、「③ 余り者になる。おちぶれる。零落して放浪する」、「④ 法を外れた言動をする。無法なふるまいをする。あばれる。暴力をふるう」、「⑤ 仕事、獲物などにありつけない結果になる」、とあります。 

 以上のような言葉の意味を考えると、「外」の世界に出る人は、必ずしも自ら進んで、喜びと期待に満ちて、冒険心に溢れて、行動力と才能を備えた人たちばかりではなく、自らの仲間や村落から追い出された人、押し出された人、逃げて行かなければならなかった人、普通に生活できない弱い人もいたのです。 探検家の関野吉晴氏が南米の最南端のナバリーノ島の住民に出会ったことを記しています。「アフリカで生まれた現生人類がアフリカを出て世界中に拡散していったが、その中で一番遠くまで行ったのがナバリーノ島に住む先住民ヤマナの先祖たちだ。もし人類の移動、拡散の原動力が好奇心や向上心だったとしたら、ヤマナは最も新進の気鋭に富んだ、好奇心と向上心の権化のような人々のはずだ。 しかし、実際は南米大陸から追い出された弱い人たちだった」。つまり、現代的な例を挙げれば、大学生の「就活」で男女ともにダーク・スーツを着て、就職したいと希望する会社の説明会や面接試験に出頭する「大学卒業見込み」という範疇に入らない人が「あぶれ者」なのです。もう少し積極的な表現を使えば、「金太郎あめ」でない者が「あぶれ者」なのです。

 したがって、「金太郎あめ」の中に納まりたくない人、「ところてん」のように一つの規格の中で押し出されたくない人、つまり横並びに同じことをしない人を「厄介者」として扱うのではなく、「変わり者」こそが、国力の総体として国が持つ活力―財力であり、文化であり、技能、知識、名声、倫理観、など、一つの国の行動の基盤となり得る諸々の価値―を増大し、豊富にしてくれるということを理解し、認識することなのです。

  歴史的に、外に出るものは、支配者側からの派遣者でなければならなかったのです。制度上、あらかじめ定められた期限がたてば帰国することになっているからです。本社採用の社員が海外赴任するのと現地雇いの社員との雇用条件に大差があるのと同じです。つまり、基本的には、人の「移動の自由」を拘束することなのです。その逆に、「私」の個人あるいは集団として外に出たものは、「移動・行動の自由」があったとしても、「公」としての支配者側からの理解も支援も受けないわけです。昔、東シナ海南シナ海で活躍した倭寇、大陸に渡って夢を追った「大陸浪人」をはじめとして満州に移住した農民などがその例でしょう。満州に移住し開墾に従事した農民が満州で保護を向けていたのは、本土からの「公」の理解や支援ではなく、関東軍の兵士の中に貧困農家出身の兵士が多くおり、満州移住者への理解・同情があったからだったのです。

 現在の状況は、といえば、最近起きたアルジェリア天然ガス精製プラントの建設プロジェクトに参加した日本企業日揮の社員が反政府軍過激派テロ集団に襲われた人質事件やフリーランスのジャーナリストが「イスラム国」を称するテロリストにとらわれ、殺害されるという悲惨な事件に対する日本の公私の反応は、「自己責任」という言葉に集約されるという悲しい話なのです。

 一昔前、日本の国際政治学会でその風潮に媚びせずに、自ら「現実主義者」と自負していた高坂正尭は、この日本国内での関心事と日本の外の世界で起きている関心事との断絶について、「日本の歴史は、国内のエリートが外に開いた部分に注意を払う視野の広さを失ったときに悲劇が起こったことを示している」と指摘し、「エリートとその背後にある国民が、どの程度、外に開かれた部分を意識し、後押しするかということが問題の中核をなす」と断言していたのです。

 

IV.

 和辻哲郎は「近世を開始した大きな発明、羅針盤・火薬・印刷術などは、すべて日本人に知られて」いたし、秀吉にしても、「ポルトガル人の航海術の優秀なことも、大砲の威力も、十分に承知していた」のに、「その技術を獲得する努力をしなかった」のだ、と説明しいます。それでも、和辻は日本人に「文化的活力はかけていたのではない」と断言しており、欠けていたのはポルトガルの「航海者ヘンリ王子」であり「ヘンリ王子の精神」に象徴される「無限探求の精神、視界拡大の精神」であったと、と結論を下しているのです。さらに続けて、「恐らくただそれだけである。そのほかにさほど多くのものが欠けていたのではない」と念を押しているのです。

 この250年に亘る「鎖国状態」に満足と言わなくとも、その現状をおかしいと考えなかったのは何故だったのか。実際「無限探求の精神」とか「視覚拡大の精神」というものが欠けていることは250年もの長期にわたり現状変更を許さないほどに強靭な思考なのでしょうか。「攘夷」から「開国」への転換は実際に起きたのです。180度の思考転換の暁に貪欲なほどに西洋文化・科学・技術を学び、摂取してきた近代の日本人は、まさに和辻が「少なくともフランシスコ・ベーコンやグローティウスのような人々の思想を眼中に置いた学者の思想」と呼んだものを以て、「日本人の新しい創造を導いて行った」人たちであり、「それに耐ええる能力を持っていた」人たちであったはずなのです。それを、「開国後の八十年を以てしては容易に克服することができなかった」のを単に「為政者の怯懦」に求めるのはおかしいと考えます。そもそも、明治維新の原動力となった人たちは「為政者」ではなかったのですから。

 まして、和辻が「日本民族が国際的な交際の場面に入り込み、世界的な視圏の下におのれの民族的文化の形成に努めること」とか「世界における日本民族の地位を確立するために」とか、「民族」という概念が、所謂「鎖国」が執られた時には存在しなかったにもかかわらず、「日本民族」の「国際的地位」を強調するのは、昭和初期以来一貫して「日本文化」の世界における位置を考察して説いてきた和辻にとって、ごく自然なことなのでしょう。そしてそのような努力を潰したのが「国内の支配権を獲得するために国際関係を手段として用いるような軍人の一人」であった秀吉であり、「国際関係を犠牲にして顧みなかった軍人の一人」であった家康であった、と「合理的な施策を蔑視して偏狭な狂信に動いた人々が、日本民族を現在の悲境に導き入れた」のだ、と大東亜戦争を敗北へと導いたのも軍人なのだ、と同列に扱うときには、あたかも「長期の孤立にもとづく著しい特殊性のゆえに」、「新しい時代における創造的な活力を失い去った」のは「為政者の怯懦」にある、とその理由を「精神」論で片付けられるものではないはずです。

 和辻自身も、日本人の「受動的閉鎖的な態度はまさにわが国の位置と歴史との産物なのである」と言明しており、「わが国の武士がただ内乱を背景としてのみ発生し、西欧におけるがごとく異民族や異なる文化圏との対立において発生したのではないという点」にその原因があるという。 つまり、日本では、

  「東亜の統一的世界への外からの侵入もなければ、また西方の世界との持続的な対立もなかった。従って限界はいつも国内に限られ、はるかなかなたの未知の世界への衝動を持たなかった。否、むしろそれは西方浄土への憧憬として、十字軍とはおよそ正反対の、柔和にして観念的なものとなった。」

 和辻がここで認めていることは、「鎖国」によって日本人が「受動的閉鎖的な態度」を形成してきたわけではない、ということです。和辻の言う「為政者の精神的怯懦」という「ただこの一つの欠点」のゆえに「日本人は近世の動きから遮断されていた」という訳ではない、と自らの主張を修正しているのです。 

 柄谷行人氏によれば、日本のような亜周辺に位置した国は、「帝国」になりえなかった、つまり単なる国家の拡大ではなく、「多数の国家の間」に生じ、「多数の共同体=国家からなると同時に、それらを超える原理」を持つものが帝国だと言います。柄谷氏によると、

   「亜周辺とは、中心から隔たっているが、中心の文明が伝わる程度には近接した空間です。それ以上に離れると「圏外」となります。亜周辺は、周辺とは違って、中心による直接的支配の恐れがなく、文明の摂取を選択的に行うことができるような空間です。」

 このように日本人の性格を見てくると、「近世の動きから遮断されていた」から「国民の性格や文化のすみずみにまで」その影響が及んでいるのではなく、もっと根本的な歴史的に古い日本という国とその文化の形成当時にまで遡ったところにあるようです。もう一度柄谷行人の言葉を借りれば、「亜周辺の者には『帝国』ないしその周辺のあり方が理解できない」からです。明治以降の「大日本帝国」の日本人も、戦後の日本人も、「帝国」を理解できないことには同じなのです。柄谷氏は以下のように結論を下しています。

    「そのため、東アジアの近隣諸国との間によい関係を築くことができない。結局、内に引きこもるか、ないしは、攻撃的に外に向かう。つまり、内閉的孤立と攻撃的膨張の間を揺れ動くことになります。日本が今後、「アジア共同体」の中に入ることはおそらく無理でしょう。」

 先に述べた岡田英弘氏によれば、「日本が現在、国際化という課題を背負って悪戦苦闘しているのは、日本がそもそも非国際化のための国家だった」からだ、と言います。『日本書紀』という歴史書が書かれたのもシナの侵略に対抗するための一種の「排外運動の一環」だったのです。「日本」と国号を名乗り冊封を拒否し、「王」の称号を「天皇」としてシナの天子に対抗できたのは、「日本を帝国の『圏外』とみなした」からであって、亜周辺に位置する日本が「何をしようと干渉できないし、またその必要も」なかった、ということです。

 その結果が、外の世界との関わりあいを拒否してできる限り排除しようとする思考の動きとなるのでしょう。言ってみれば「自己防衛」のための「外の世界」からの遮断なのです。これこそがまさに、昨今の日本の「集団的自衛権」に関する非生産的な議論と同じ発想なのです。

 和辻の『鎖国』の中に含まれている原資料に基づく記述はほとんどのものが外国人によるものであることが日本側からの興味の浅さを如実に示しています。例えば、異教徒であるサラセン人やムーア人との戦いを通じて形成されてきたポルトガルについて、「我々にとって意義深いのは、アラビア人との対抗や未知の世界への進出の努力が、学問と技術との研究という形に表れていることである」と指摘しており、ポルトガル人と日本人との外の世界に対する態度について「著しい性格の相違」があることを認めているのです。前者の運動には「無限探求の精神と公共的な企業の精神とが結びついていた」のに対して、後者の運動な、「『あぶれ者』の精神によって貫かれ、無限探求と公共性とのいずれをも欠いていた」、とその違いを以下のように示しているのです。

   「西からマラッカまで来た努力は、ヨーロッパ近世の視圏拡大運動の先端としての性格を持っていた。しかるに東からマラッカまで行った努力は、日本人の公共的な記憶に残らず、また日本人の探求心に寄与することのないものであった。」

 このことは、江戸時代後期に長崎出島におけるオランダ東インド会社との情報交換が定期かされていた時ですら何ら変化は起きなかったのです。ケンペルの好奇心、探求心とそれを学術的なものとして後世に残していくという公共的な記憶に残していくという努力と比べたら、日本側からの努力は単にケンペルの著作を翻訳することだけなのです。 

 日本文化の持つ力は、外からの文化を摂取できる包容力と、日本文化の中に摂取されたものを内在化させる能力です。芥川龍之介が『神神の微笑』の中で老人に言わせてるように、「我我の力と云うのは、破壊する力ではありません。造り変える力なのです」と。その「造り変える力」こそ、「亜周辺性」ともいわれるフレキシブルな性格に象徴される自由な包容力です。それが亜周辺に位置する国として文明帝国から自立するために、日本人が古代より育んできた力なのです。ただし、この自由でフレキシブルな性格は逆に亜周辺であるが故に、「理論的・道徳的な態度」を嫌うことにより、「普遍的な理念性」を持ちえないと言われています。しかし、日本を世界帝国であるシナの亜周辺にある国と見ることによって、古代より歴史上、世界帝国の亜周辺にある国々は、日本と同じような文化的変遷の過程を経てきたことがわかります。ペルシャやエジプトに対する古代ギリシャローマ帝国に対するゲルマンの諸国、アラビア文明に対する中世ヨーロッパ、神聖ローマ帝国に対するイギリスなど、多々あります。その一つ一つの亜周辺にいる国々が、大文明帝国に吸収されずに、自立しようとする過程において文字言語という「帝国」の言語に対する自らのことば、音声中心主義的なことばを作っていったのです。そのように考えれば、柄谷氏が言うように「特殊日本的と見えた諸問題が普遍化できる」でしょう。

 それはジャポニカなどのように西洋から発見されるものではなく、日本から外に向かって発信する物なのです。『神神の微笑』の中で老人が言ってます、「西洋も変わらなければなりません。・・・御気をつけなさい。御気をつけなさい」と。あたかも私たちに、「確りしなさい。自ら造り変える力を行使しなければ、逆に呑み込まれますよ」と、忠告しているように。

 残念ながら、日本文化の中に内在化された外来文化は、日本版としての概念であり、日本の中でのみで理解されるものなのです。それが結果的に日本文化の排他性であり閉鎖性となるのです。ですから、異邦人同士の両親(日本人の父と外国人の母又はその逆)を持つ子供を「ハーフ」と公然と呼ぶことに、何ら「おかししい」と違和感を覚えないことが日本版概念の排他性・閉鎖性を立証しています。

 日本の「国際化」教育の悲劇は、外に出る者は、「公」の承認を受けた派遣計画の一環でない限り、基本的には「あぶれ者」であって、「国際人」として外で活躍していても、ひとたび日本に戻って来たとしても、「いつまでも『あぶれ者』であって、政治的な意義を獲得する」ことは難しいのです。岡田氏いわく、「社会がまず受け入れてくれないのである」と断言しています。そこに、日本の「国際化」教育に潜む根本的な閉鎖性があります。###

 

 

 

 

 

 

 

マイケル・ピルズベリー著『China 2049』が警告すること

   著者のマイケル・ピルズベリー博士は「1969年に中国との連携を後押しする最初の情報をホワイトハウスに提供したひとり」(『China 2049』(日経BP社、2015年、12頁。以下頁のみ)であり、それ以降、「数十年に亘って、技術と軍事の両面で中国を援助することを両党の政権に促してきた」人なのです。そして自ら「ニクソン政権以来、30年にわたって中国の専門家として政府機関で働いてきた。したがって他の誰よりも中国の軍部や諜報機関に通じていると断言できる」、と豪語しているひとなのです。(25頁)その人が、中国の世界制覇の戦略を見抜くことができず、中国に騙され続けていたと告白しているのですから尋常な話ではないのです。

 著者によると、過去40年に亘って、中国のタカ派は、北京の指導者を通じてアメリカの政策決定者を操作し、情報や軍事的、技術的、経済的支援を得てきた、という。そのもとになる計画こそタカ派毛沢東以降の中国指導者の耳に吹き込んだ「100年マラソン」と呼ばれるものであったのです。つまり、「過去100年に及ぶ屈辱に復讐すべく、中国共産党革命100周年にあたる2049年までに、世界の経済・軍事・政治のリーダーの地位をアメリカから奪取する」というものだ、という(22頁)。それが原本のタイトル、『100年マラソン』(The Hundred-Year Marathon)なのです。この訳本は中国共産党革命の勝利である中華人民共和国設立1949年から100周年の2049年をタイトルにしています。

 

I.

 本書は、著者が中国の国家機密を暴露する、という代物ではなく、著者が自らの覚醒により新たに辿り着いた解釈のもとに、中国タカ派の主張こそが「中国地政学的戦略の主流である」(26頁)という著者の確信に基づく分析なのです。著者が本書の末尾の「謝辞」の中で述べているように、50年に亘る研究・情報分析のキャリアーをかけて本書は出来上がっていますが、その間34名の中国人「儒将」との議論や意見を戦わしたりする稀有な機会から得られたものも本書の形成に貢献しているのも事実です(360頁)。ただし、ここで大事なことは、著者が「誰ひとり、国家機密を守り共産党の方針を支持[訳本にある「指示」は誤植、つまり訳者・編集者の校正の間違い]するという誓いを破らなかった」(360頁)と特記しているように、本書には中国側からの新しい事実の暴露も情報開示は無いのです。当然のこととして本書の巻頭の「筆者注」にあるように「本書は、機密情報が漏洩しないよう、刊行前にCIA、FBI、国防総省の代理によって査読を受けた」(2頁)と記されているように、新たな情報は無いのです。

 したがって、驚くべきことは、米国側の中国問題専門家や対中国政策にかかわってきた政府官僚・政治家たちが中国の対外政策を読み違えてきた、ということなのです。米中関係修復の発端となったニクソンの訪中に関しても、「ニクソンから中国に近づいていったのではない。中国が、毛という人間を通して、ニクソンにち近づいてきたのだ。アメリカ人はそれを知らなかった」(87頁)とか、「政権はすぐ、秘密裏に、かつ強力に、中国を軍事支援した。すべては、米中は恒久的な関係を築きつつあるという間違った仮定に基づいていた」(93頁)のように、「一連の成り行きを、できる限り肯定的にとらえようとした」(132頁)ので、「1980年代にCIAあるいは国防総省で私と一緒に働いたスタッフの中に、中国がアメリカをだまそうとしてとか、諜報上の重大な失策を招く恐れがある、と考えていた人はいなかった」し(133頁)、「わたしが覚えている限り、中国にはさらに深い計算があり、やがてアメリカは対中戦略の見直しを強いられることになる、と予測する人はいなかった」のです(148頁)。さらに米国に不利なことが明らかになっても、「中国に関する私たちの満足と楽観は揺らがなかった」し(150頁)、米当局の大半は、反米の兆候を完全に無視したし、中国指導者のアメリカに対する非難は翻訳されないという指示があることを知っても、「その時ですら、わたしが中国の未来に対して抱いていた信頼は、多少、揺らぎはしても、消えはしなかった」ので(151頁)「私は依然として中国懐疑派ではなかったし、また、どの筋からの情報もこれは一時的な段階に過ぎないと語っていた」というのです(151頁)。

 

II.

 なぜアメリカ人は中国に対して自己に不利になるような客観的事象に対して「否定」するような思考を執拗なほどに執るのでしょうか。パール・バック女史が著した『大地』(1931年)に見られるような中国に対する理解、同情は数多くの米国人宣教師による宣教活動に裏ずけられたものでした。米国は他のいかなる列強よりも中国に対して寛容であったし、今でもその基本的な思考様式は変わってないのです。中国において現実的な利害が少ない米国は、中国の潜在能力を信頼をし、どちらかといえば理想主義的な政策に走る嫌いがあったのです。(ジョン・アントワープ・マクマリー[原著]/アーサー・ウォルドロン[編著]『平和はいかに失われたか』、原書房、1997年、119頁)。その同じ姿勢が本書のいたるところに見受けられます。その原因はジョージ・ケナンによると「我々自身の情緒的コンプレックス」にあるといいます(『アメリカ外交50年』、岩波現代文庫、2000年、78頁)。反対に日本にとって中国は、経済的にも、政治的にも不可欠な存在だったし、現在でもその状況に変化はないのです。そこに米国と日本の対中政策に全く違った利害関係を生んできているのです。

 日米関係は歴史的に絶えず米中関係に影響を 受け、悩まされて来ました。日・米・中三国の 共通項は、米国なのです。米・日関係と米・中 関係の競合関係は米国をもとに左右二辺に分かれるのです。ただし、米国という共通項を持っていても、日米の中国に対する利害関係には差があります。その差を持った二辺が創るいびつな三角形の底辺が日・中関係であり、そこに日米対米中という競合関係が投影されるのです。その後ろには、ピルズベリー博士が指摘するように、ブッシュ大統領ニクソン大統領の対中国政策を踏襲することを「アメリカのビジネスリーダーはよしとした。彼らは、いずれ世界最大の市場になるはずの中国とのつながりを深め、ビジネスの機会を拡大することを熱望していたからだ」といいます(140頁)。ちょうど、19世紀に眠れる獅子清国の富を求めて利権獲得のために乱入した如く、現在のヨーロッパ諸国が新たに設立された「アジア・インフラ投資銀行」に群がるのと同じです。 

 先に言及した『平和はいかに失われたか』にジョン・アント ワープ・マクネリーの手による「極東情勢の展開 とアメリカの政策」というメモランダムが収録さ れていますが、その中でワシントン会議が鋭利 に分析されています。その本の編者であるアー サー・ウォルドン教授が、日英同盟の解消は、「英国のアジア政策というよりは、英国の対米政策で あったとする方が適切であろう」という非常に興味深い評価を下しています(『平和はいかに失われたか』、60頁)。 そこで、日本の国益を考えるために一つの頭の体操として、この ウォルドン教授の評価を「日米同盟」に転化してみ ましょう。すると、現在日本が直面する問題が浮き彫りに成って見えてきます。日米同盟は、中国にとっては眼の上のたんこぶと考えており、両国の間に楔を打ち込もうとしています。中国は再三米国に対して米中の新しい「大国」関係を構築するようにはたらき掛けているのです。いつ米国が対中関係の認識を変えていくかは、中国と手を組むほうが米国にとってより大きな利益になると考える時でしょう。その一つが、電撃的なニクソン訪中であったのです。つまり日米安保条約の終結は、米国のアジア政策というよりは、米国の対中政策によって起こり得るものなのです。 かつての中国の広大な市場としての重要さに加え、いまや世界経済を牽引する「世界の工場」としての中国と、さらに益々力を増大してきている軍事大国としての中国とに対して、米国は経済力第2位の中国を必要としているし、米国と対峙するように成長した軍事大国である中国との大国同士の相互理解を深め相互の「行動規範」を作り上げる必要があることを充分認識しているはずです。 2014年から中国海軍は米海軍が主催する最大規模のリムパック(環太平洋合同演習)に招待されているのです。そこに日米の対中国観に、既に大きなずれが出ています。米国は、日本では普通イージス艦と呼ばれている誘導ミサイルを搭載している駆逐艦ラッセン」を国際慣習法国連海洋法条約によって認められている公海での「航行の自由」権を行使するために「航行の自由」作戦(FONOP)を実施いた、と言われていますが、その直後、11月7日に大西洋での最初の米中合同海軍演習が行われているのです。

 

III.

 では、その「航行の自由」作戦の実態はどうだったのでしょうか。「航行の自由」という権利は公海上のことであり、中国が領有権を主張している南沙諸島にある一つの岩礁を埋め立てて人口の島を造成して、その周辺の海域を中国の領海であるという国際法に違反する主張を認めないという意思表示を行動を以って示したわけです。そのために、中国が領海であると主張する海岸から12海里の海域内に入って航行をしたという発表がありました。ところが駆逐艦ラッセン」の航行の自由権の行使から三日も経たないうちに、「ラッセン」が実際に行なったのは、公海上での「航行の自由」権の行使ではなくて、領海内を航行する「無害通航」権の行使であった、という事実が出てきたのです。ここで留意すべき大事なことは、「無害通航」と公海での「航行の自由」というものは全く違う概念であり、それぞれ異なった結果を生じさせるものである、ということです。国際慣習法国連海洋法条約によって規定されている現在の海洋法体制の下では、「無害通航」というものは沿岸国の領海を通航するというすべての主権国家が同等に持つ権利であり、その通航が継続しており迅速に行なわれること、沿岸国の平和、秩序又は安全を害しない限り、無害とされる、と規定されています。また、その通航にはいかなる兵器や艦載機の使用、調査活動又は測量活動の実施、通航に直接の関係を有しないその他の活動をすることは禁じられているのです。

 そもそも米国が「航行の自由」作戦にスビー礁を選んだのは、その岩礁が低潮高地のためと、その全部が本土又は島から領海の幅を超える距離にあるため、それ自体の領海を有しないからです。さらにその岩礁を埋め立てて造成された人工島は島としての地位を有しないし、それ自体の領海を持っていないからです。ですから駆逐艦ラッセン」の「航行の自由」作戦の目的はスビー礁の上に埋め立てをして人工島を造成したとしても、最初から領海をもち得ないのですから、そのような中国の一方的な領海の主張は承認しないことを示すところにあります。つまり、スビー礁の周辺の海域は公海である、という前提があります。残念ながら「ラッセン」が成し遂げたことはその逆のようでした。挑発と見られることを避けることに気を配りすぎ、「ラッセン」は公海上での航行の自由権を行使しないことを選んだのです。

 イージス艦一隻だけを派遣するということは確かに、あえてこれ以上の緊張を高めることは避けたい、という意図が読み取られるのですが、逆にどの国が理不尽な拡張政策を執って、この緊張を高めてきたのかを考えれば、米国の反応は時既に遅きに失し、「航行の自由」という示威行動の内容もあまりにも控えめで、穏便なものであったのです。何故ならば、イージス艦ラッセン」の執った行動は沿岸国の領海を通航するのに要求されている「無害通航」の条件を全て満たして通航する権利を行使したからです。

 「ラッセン」が、無害通航権を実質的に行使した、という事実は、結果として、「ラッセン」の執った行動は、スビー礁の海域は中国の領海であるという中国の主張を、その行動によって受け入れた、ということになります。「ラッセン」は搭載されている自前のヘリコプターを飛ばすことをせずに、対戦レーダーの運転を停止したままで12海里以内の「領海」を通航したのです。まして、「ラッセン」の艦載機ではないP-8Aポセイドン対潜哨戒機も、スビー礁から12海里の領空内に入らずにその空域の外にいた、という事実がこの「航行の自由」作戦の実態を如実に語っています。 端的にいえば、「ラッセン」の航行の自由作戦と呼ばれているものは、名称のみであって、実際の作戦行動自体が明らかに表明したものは、中国の領海であると中国が主張する海域の中を通過する「無害通航」権を行使した、ということなのです。もし実際に「ラッセン」が公海上での「航行の自由」権を行使していたならば、航行の自由権は、国際法で領海では許されない活動であっても、公海上では合法である活動を執行することができたはずなのです。「ラッセン」は、あえて、それをせずに公海上での航行の自由権が与える飛行の自由をも行使しなかったのです。つまり、「ラッセン」は、カーター国防長官が表明したような「どこでも国際法が許すところで飛行し、航行し、行動を執る」ことをしない道を選んだのです。同伴飛行をしていたP-8Aポセイドン対潜哨戒機は、スビー礁の人工島の上空12海里の“領海”と主張される空域には入らない、という選択をしたのです。

  実際に起きたことは、領海を予告なく通過するという国際法で許される「無害通航」をしたという事実です。米中両国がそのお互いの権利主張を公然と言い合うことは、公海上の「航行の自由」という公に発表された虚構を維持するための「カブキ」興行だった、との印象を避けられないのです。

 同じようなことが12月10日に起きています。米空軍のB-52爆撃機南沙諸島に位置するクアルテロン岩礁の2海里以内上空を飛行したが、それは意図的な出来事ではなく、12海里以内の上空を飛行する予定は全くなく、たまたま悪天候のためにパイロットが飛行すべきコースを外れてしまったのだと説明をしています。つまり国際法上認められている公海上空での飛行の自由を行使したとは主張していないのです。結果的には、駆逐艦ラッセンの無害通航と同じようにB-52の飛行は中国の領空の主張を受け入れているのです。 

 

IV.

 今年10月に開かれたアセアン(ASEAN)国防相会議で南シナ海の紛争に対して共同声明が採択されなかったことは、アセアン加盟国間の利害の錯綜のみならず、中国の増大する影響を無視できないことを示しています。中国は、自らが最も好み、得意とする外部者を排除して直接利害関係を持つ者のみを対象にした「一本釣り」をすることにより、その当該国と「二国間交渉」に入ることにより、自国の力を活用するのです。中国の「富」から恩恵を得たいと考える国は多々おります。中国の人民元が、IMFのSDRの構成貨幣の一つとなり国際通貨として認められることが決定されました。人民元の国際化を 世界財源として歓迎すべきなのでしょうが、人民元が国際決済通貨として使用される度合いが増せばますほど中国のブレトン・ウッズ体制への挑戦となります。中国は国際法規範、慣行を無視し、何のおとがめも無く拡張政策を追求しているのです。このような中国の政策は、膨大な陸のシルク・ロードと海のシルク・ロードと言われる「一帯一路」の大計画は「人民元金融圏」の構築への一翼を担うものですし、アジア・インフラ投資銀行は中国の世界覇権掌握のための道具なのです。中国の狙うところは中華世界秩序の構築と朝貢体制を再び復興させることなのです。本書で著者はリー・クアンユーシンガポール首相の話を紹介しています。「中国の目的は世界一の大国になることだ。そして、西洋の名誉会員としてではなく、中国として受け入れられることであり(中略)彼らの思考の中心にあるのは、植民地化とそれがもたらした搾取や屈辱より前の、彼らの世界である」とリーは明言していたのです。(351-52頁)。 

 人民元資金供給こそが中国の軍拡の原動力なのは周知の事実です。国際通貨となり、英国の援けもあり、ロンドン・シティーでユーロ・人民元金融市場が出来上がれば、中国は自由に人民元紙幣をさらに印刷することができるようになり、中国の軍拡は益々高まります。米中の軍事バランスは均衡するどころか、米国に不利になるでしょう。そうなる前に米国はその国益を護るために動くはずです。

 その時に、日米関係の重要性が故に、その緊密な関係を維持すること自体が日本外交の目的となるような国益を忘れ、独立国としての主体性を失った外交政策を執った結果、日本の頭越しに米中和解という「ニクソン・ショック」という悲哀と屈辱を二度と味あわないように、備えなければ成らないのです。それは、中国が公然と表明している願望である、「太平洋は米中両国を抱擁しても余るほど広大である」ので、太平洋を東西に二分して、東側は米国が、西側は中国が、それぞれ支配する、という中国が求める米国との「新しい大国関係」がいずれ成立する時に備えなければならないのです。###

 

 

 

 

 

 

 

 

 

The U.S.-China Condominium of the Pacific Ocean: Implications of the USS Lassen’s Innocent Passage in the South China Sea

Michael Pillsbury’s recent The Hundred-Year Marathon reveals at length how the past eight United States presidents, from Richard Nixon through Barack Obama, had carried out, as a matter of policy, a series of initiatives to strengthen China against its adversaries. For more than 40 years, the United States has helped China to build the world No. 2 economy and develop its scientific and military capabilities in pursuit of the “Chinese Dream” in the realization of the “great renewal of the Chinese nation,” to use Xi Jinping’s pet phrase.

 

U.S. assistance to the development of China was not limited to innocuous “cultural exchanges” in academia, but it purposefully focused on military know-how and engineering. It provided China with “major weapons systems” to strengthen its “army, navy, and air force, and even to help China to expand its marine corps.” It also extended to “genetic engineering, intelligent robotics, artificial intelligence, automation, biotechnology, lasers, supercomputers, space technology, and manned spaceflight.”   

 

Behind such expanding aid programs for China in the past decades, notes Pillsbury, are “American business leaders eager to maintain their growing relationships and business opportunities, as China almost certainly promised to be the largest emerging market in the world” just like Europeans today who have flocked to the newly established Asian Infrastructure Investment Bank.  

 

With these sobering revelations about the U.S.-China relations and the presence of Xi Jinping in the helm today as the aggressive promotor of the “Chinese Dream,” we need to examine the implications of what is officially referred to as the Freedom of Navigation Operations (FONOP) within 12 nautical miles of an artificial island built on Subi Reef in the Spratly Islands on October 27, 2015.

 

I.

The USS Lassen, a guided missile destroyer, accompanied by two maritime surveillance aircraft, a P-8A Poseidon and a P-3 Orion, conducted FONOP to demonstrate that the United States did not recognize China’s unilateral claims of Subi Reef’s territorial sea. The news hit the headlines around the globe. Many people were relieved to know that the Obama administration finally acted on a growing Chinese threat in the South China Sea and supported the United States’ action.

 

On October 30, three days after the initial news, however, media, starting with Defense News, carried different stories that what the Lassen conducted was actually “innocent passage” in the territorial sea and not “freedom of navigation” on the high seas. That stark revelation cast the entire the Lassen’s mission into a totally different picture of the control of the South China Sea. According to Defense News,

 

New details about the Lassen’s transit became available Oct. 30 from a US Navy source, who said the warship took steps to indicate it was making a lawful innocent passage with no warlike intent. The ship’s fire control radars were turned off and it flew no helicopters, the source said. Although a US Navy P-8 Poseidon maritime surveillance aircraft was in the area, it did not cross inside the 12 nautical mile limit.  

 

The USS Lassen’s innocent passage produced two immediate developments. First, on November 11, China for the first time began introducing PLA naval warships, rather than Coast Guard vessels, in the vicinity of the Senkaku Islands. Second, on November 27, according to Jane's, "An unusually large ... formation of eight bombers supported by three surveillance and electronic intelligence (ELINT) aircraft" flew 1,000km over the East China Sea into the Second Island Chain that runs from the Izu Islands through the Bonins Islands, the Marianas Islands, Guam, and the Caroline Islands to Papua New Guinea.

Innocent passage and navigation on the high seas have totally different meanings and carry different consequences. The present law of the sea regime established by customary international law and the UN Convention on the Law of the Sea spells out that “innocent passage” is the right of every state to navigate through the territorial sea of the coastal state so long as a passage satisfies certain conditions such as it being continuous and expeditious, and not prejudicial to the peace, good order or security of the coastal state. Such passage cannot use any weapons, use any aircraft or carry out any survey or undertake any other activity not having a direct bearing on passage.

 

And that right of innocent passage in the territorial sea is precisely what China’s People’s Liberation Army (PLA) Navy fleet exercised in early September this year when it transited U.S. territorial waters in the Bering Sea off the Aleutian Islands. There is one crucial difference in this Bering Sea transit, however. The territorial sea of the Bering

Sea is not contested by any state; it is undisputedly the territorial sea of the United States. The sovereignty of the Spratly Islands is disputed by multiple parties of the South China Sea.

 

II.

The choice of Subi Reef for FONOP was deliberately made because the Chinese artificial installation built on a low-tied elevation cannot be subject to territorial sea claims. The purpose of the Lassen’s FONOP was to demonstrate that the rest of the world did not recognize such unilateral declaration of the “territorial sea” of the man-made artificial island on Subi Reef. What the Lassen achieved was the opposite effect. Desirous of avoiding provocation, the Lassen chose not to exercise freedom of navigation on the high seas. The Pentagon denies that the Lassen conducted an innocent passage, and insists that it exercised freedom of navigation. Unfortunately, its argument is circular: (1) a low tide elevation at Subi Reef does not confer any territorial sea rights; (2) innocent passage is only applicable in the territorial sea of the coastal state, but waters of Subi Reef belong to the high seas; and (3) the Lassen’s transit in the waters within 12 nautical miles of Subi Reef, which are part of the high seas, cannot therefore be described as “innocent passage.”

 

The notable FONOP was the Gulf of Sidra Incident in 1981 vis-à-vis Libya. Granted that the Subi Reef situation is somewhat different from Libya’s claims in 1973 that designated the Gulf of Sidra as a closed bay and part of its territorial sea, but with an airport of a 3000-meter runway in near completion on the artificial island on Subi Reef, the situation is more serious than that of the Gulf of Sidra. But President Obama’s response to unlawful claims was a radical departure in form and substance from previous FONOPs. In the Gulf of Sidra, the FONOP sanctioned by President Ronald Reagan in 1981 had a large naval force led by two aircraft carriers.

 

Dispatching a single destroyer alone must be meant to communicate that the United States did not intend further to heighten growing tensions in the South China Sea. But the paucity of response from the United States, the only sea power capable of dealing with China in the South China Sea, to unlawful activities has allowed China to accomplish what it had intended to do in these reefs of the Spratly Islands. The Lassen’s FONOP took place a little too late, and its operational substance was too modest to demonstrate its professed objective of the action because the Lassen complied with all the conditions attached to the conduct of “innocent passage” in the territorial sea of the coastal state.

 

The fact that the Lassen conducted an “innocent passage” in the end demonstrated by deed its acceptance of China’s claims of the territorial sea of Subi Reef. The Lassen did not fly its helicopters during its transit within 12 nautical miles of Subi Reef installations; nor did the P-8A Poseidon surveillance aircraft that accompanied the Lassen enter the air space above the 12-nautical mile limit. Though they called the Lassen’s mission Freedom of Navigation Operations, it was the name only. Its conduct itself spoke more loudly and clearly. It was an innocent passage within the waters China claims its territorial sea. And China understood it perfectly well. Chinese Foreign Ministry Spokesperson Lu Kang’s statement was rather muted: “Relevant actions by the U.S. naval vessel threatened China’s sovereignty and security interests. . . . The Chinese side hereby expresses strong dissatisfaction and opposition.”

 

If indeed the Lassen exercised freedom of navigation on the high seas, freedom of navigation would have allowed the Lassen to undertake activity that is legitimate on the high seas but not permissible in territorial waters under international law. Freedom of navigation also gives freedom of overflight. The Lassen chose not to “fly, sail, and operate wherever international law allows,” as Secretary of Defense Ash Carter announced. The P-8A Poseidon maritime surveillance aircraft chose to stay out of the air space above the 12 nautical mile of the Subi Reef artificial island. It demonstrated by deed its respect for the territorial boundary of sea and air space of the Subi Reef artificial island.

 

III.

A series of events surrounding the Lassen’s FONOP gives us some clues: (1) pronouncements and leaks made by U.S. officials of the planned “freedom of navigation” operations well in advance; (2) radio communications to the PLA Navy that the Lassen’s operations were not harmful nor discriminatory to China; (3) a video conference on October 29 between top U.S. and China naval officers (Chief of Naval Operations, Adm. John Richardson and Commander of the PLA Navy, Adm. Wu Shengli); (4) Commander of the U.S. Pacific Command, Adm. Harry Harris’s visit to Beijing on November 2; and (5) the first U.S.-China joint naval exercise in the Atlantic Ocean on November 7; (6) the USS Stethem’s visit to Shanghai on November 16; and, may I add, (7) the White House’s instructions to Defense officials to be quiet about the Lassen’s FONOP, as reported in The New York Times. They all give the impression that the Lassen’s FONOP was scripted, choreographed and well-staged in the name of “freedom of navigation.” In reality it was the conduct of innocent passage in the territorial sea of the coastal state. Loud verbal exchanges between China and the U.S. asserting their respective rights are just a “Kabuki” performance to maintain the façade of officially pronounced “freedom of navigation” on the high seas. 

 

In the first public speech after the Lassen’s “innocent passage,” President Xi Jinping confidently reiterated in Singapore on November 7 that “islands in the South China Sea have been China’s territory since ancient times, and the Chinese government must take responsibility to safeguard its territorial sovereignty and legitimate interest.” Moreover, on November 22 at the ASEAN Summit in Kuala Lumpur, Mr. Liu Zhernmin, China’s Vice-Minister of the Ministry of Finance, said matter-of-factly, “Building and maintaining necessary military facilities, this is what is required for China’s national defense and for the protection of these islands and reefs.”    

  

A closer examination of these developments above leads us to conclude that the United States implicitly recognized the territorial sea claims of China in Subi Reef, and we must examine what would be the implications of this “recognition” not only to the security of the South China Sea alone, but also to the East China Sea and beyond. 

(a)  The United States expects that China will adjust to “a new normal” just the way Japanese Coast Guard ships have been routinely confronting Chinese Coast Guard vessels’ regular incursions into Japan’s territorial waters of the Senkaku Islands. It is unfortunate that such analogy was drawn between Chinese Coast Guard ships’ violation of the territorial waters of the Senkaku Island and the Lassen’s mission around Subi Reef.  The immediate impact will be on the situation of the Senkaku Islands. As mentioned at the outset, China will be more assertive in its claims of the territorial waters around the Senkaku Islands.

(b)  The Lassen’s innocent passage may adversely affect the future development of the Philippines v. China, an ongoing international arbitration case relating to maritime boundaries in the Spratly Islands before the Permanent Court of Arbitration at The Hague. The Court just issued an award on jurisdiction and admissibility on October 29, 2015 in favor of the Philippines. But that victory was only “a go-sign” for the Philippines to enter the ring, where the real fight would take place. The merits phase hearings were held from November 24 to 30, 2015 at The Hague. As the knowledge of the Lassen’s innocent passage as a tacit U.S. recognition of China’s territorial sea claims is widely shared by many, it may affect the minds of arbitrators on the bench.    

(c)   The outcome of the Philippines case against China will most likely determine the fate of China’s grandiose, but grotesque claims of the Nine-dash Line based on

historical grounds in pursuit of “the realization of the Chinese Dream of the great renewal of the Chinese nation.” Such claims would not only threaten freedom of navigation in the South China Sea, but also potentially jeopardize the use of the most important two straits in the south: the Strait of Malacca between Malay Peninsula and Sumatra, connecting the South China Sea and the Indian Ocean; and the Sunda Straight between Sumatra and Java, connecting the Java Sea and the Indian Ocean. These two straits are strategically the most important controlling points of sea lanes connecting the Indian Ocean and the Pacific Ocean. Also in the north, there are two important straits: the Bashi Channel in the Strait of Luzon between Taiwan and the Philippines; and the Miyako Strait between the Okinawa Island and the Miyako Island. These two straits in the north are for the PLA Navy to access the Pacific Ocean. For the first time in 2010 the PLA Navy transited through the Miyako Strait to the Pacific Ocean. Since then, the passage of the PLA Navy through the Miyako Strait has become an annual event for the Chinese naval exercise in the Pacific Ocean. The Bashi Channel allows the PLA Navy fleet to return to the South China Sea without going back to the Miyako Strait, which is subject to Japanese surveillance. China is now positing itself to deal with the next hurdle, i.e., the Second Island Chain.

 

IV.

With the airport on Subi Reef nearly being completed, U.S. policy of being neutral to territorial and maritime disputes has allowed the rule of naked power to prevail. As China increases its A2/AD capabilities, it may not be so far away for the East China Sea and the South China Sea to be effectively controlled by China.

The inability of ASEAN defense ministers meeting to adopt a joint statement on the South China Sea disputes on November 4, 2015 indicates not only the presence of competing and crisscrossing interests among ASEAN member countries, but also a growing Chinese influence. China uses its most preferred mode of “bi-lateral negotiations” between the two parties directly concerned with the issue at stake, rejecting the involvement of any outside parties. China thus deals with one country at a time from the position of strength. All countries want to benefit from China’s riches. China’s Renminbi will soon become an international currency as one of the IMF’s SDR basket currencies. The world should welcome the internationalization of the Renminbi as a source of global liquidity. But China pursues policy of outward expansion with impunity in defiance of international norms and comity.

The more the Renminbi is used as an international settlement currency, the more it will be considered China’s challenge to the Bretton Woods system. The grandiose vision of “The Silk Road Economic Belt and the 21stCentury Maritime Silk Road” or otherwise known as “the Belt and Road Initiative” was originally announced by President Xi Jinping in pursuit of the “Chinese Dream.” It is designed to create a vast economic zone embracing a new Eurasian economic belt in the north and a new maritime route in the south starting from the eastern seaboard of China through the South China Sea, the Indian Ocean, and Middle Eastern and East African countries to the EU. It is the wing that will lift the development of “the Renminbi Financial Zone.” The AIIB is a vehicle to realize that Chinese dream. What China aims at would be the establishment of China-centric world order with the renewal of its global tributary system.

It cannot be denied that the funding source of China’s military expansion is the growing supply of the Renminbi. With the internationalization of the Chinese currency together with the opening of the Euro-Renminbi market in the City, London, under the auspices of the U.K. government, China will be in a more advantageous position to print more Renminbi bills at will and its military power will expands correspondingly. As Pillsbury remarked on the basis of the RAND Corporation’s study, “From now through 2030, the Chinese will have more than $1 trillion available to spend on new weapons for their navy and air force”. “This,” concludes Pillsbury, “paints a picture of near parity, if not outright Chinese superiority, by mid-century. The future military balance of power is slowly shifting, from a ten-to-one U.S. superiority, toward equality, and then eventually to Chinese superiority.” Before that happens, I suspect influential American business leaders, who are major donors to presidential campaigns, will lobby the administration to promote and protect their vast business and commercial opportunities in China. New support will be no doubt mobilized in Congress, of course, for the protection of constituents’ interests. Sooner or later, the United States would make a move to protect its own interest by providing America’s goodwill and assistance to China as usual because of “a certain sentimentality toward the Chinese” as George Kennan pointed out long ago.

The Obama administration is trying hard not to offend China as demonstrated again by the Pentagon’s explanation that a B-52 bomber’s flight on December 10, 2015 within two nautical miles of Cuarteron Reef in the Spratly Islands was “unintentional.” That is, the B-52 bomber did not plan to fly to within 12 nautical miles, and according to the Wall Street Journal, bad weather had contributed to the pilot flying off course and into the area claimed by China. It denied its own freedom of flight over the high seas, as recognized by the U.N. Convention on the Law of the Sea and customary international law. The Pentagon did not maintain that it exercised its lawful right under international law. Rather, as consistently demonstrated above, the U.S. Navy and Air Force recognize the territorial sea as well as space claimed by China in the Spratly Islands, if not the South China Sea.              

We have to be prepared for that eventuality, so that we would not repeat the same fate of being dumbfounded at the United States’ rapprochement with the Communist China in 1971. The so-called Nixon Shock and its resultant humiliation, sorrow, disappointment, and anger at being bypassed by the United States, with which we thought we had a special relationship, taught us a lesson. To maintain the close relationship with the United States cannot be the sole purpose and objective of Japan’s foreign policy, but a means to safeguard Japan’s interest.

We have to prepare ourselves for the inevitable U.S. acceptance of China’s offer of “major-power relationship with the United States,” which President Xi Jinping has been seeking. It is an open secret that China considers the Pacific Ocean large enough to accommodate the United States and China, the former controlling the eastern half of the Pacific Ocean and the latter controlling the western half of the Ocean. It would be the U.S.-China Condominium of the Pacific Ocean, and the Lassen‘s innocent passage was a prelude to the shaking hands of the United States with China ###

COP21 と「先にやった者の勝ち」というルール

 2015年11月30日から12月11日まで、フランス・パリで、気候変動枠組条約第21回締約国会議(COP21)が開催されています。交渉の焦点のなっているのは先進国対途上国の利害の対立なのです。途上国としては、地球温暖化の問題は理解できるけれども、自ら貧困削減と生活水準の向上という正当な経済開発政策遂行を阻害するようなことはできない、という理由があります。そもそも、産業革命から始まり石炭の需要が大きくなり、石油が新たなエネルギー源に加わり、先進国こそ、先に産業化、工業化を成し遂げて富を創り築き上げてきた国々が、その過程において、「先にやった者」としての地球温暖化プロセスを推し進めてきた、という歴史的責任を否定できないはずである、という訳です。

   日本もかつて「遅れて来た者」としての悲哀を、「領土の獲得」、「保護貿易」などの分野で味わされてきました。現代の地球温暖化対策に対応するための措置に関して途上国が押し付けられている「遅れて来た者」としての不平等性は、「先にやった者」が今まで自由勝手にやってきた行為を同じように遅まきながらやり始めたときに、「先駆者」の自由裁量で新たに作られる規則で禁止される、という状況に置かれていることです。「遅れて来た者」は追い着くことに忙しくて、その対象である当該行為にまつわる時間の経過と新たなゲームのルールの発展に往々にして無頓着であったのです。 第一次大戦の戦後処理としてのヴェルサイユ講和会議での欧米先進国が持ち出した「平和主義」、「国際協調」、「主権尊重」、「領土保全」などの新しい理念・原則を理解できずに会議の進行中の議論に参加できず「サイレント・パートナー」と揶揄された大日本帝国代表団が狼狽し混迷した姿をさらけ出していたことに表れていました。 同じようなことは、現在の中国がさらけ出している汚染の実態を見れば良く分かることです。

   新しい技術やノウ・ハウの利用にまつわる許容性の究極的な尺度は、その国が先駆的な能力を排他的に持っているかどうか、でしかないのです。つまり、「先駆者」としてある行為を行う能力を持った者はその行為の果実を享受でき、「先駆者」と同じ能力を後から取得しても、「遅れて来た者」は、その能力を身に着けたとしても、その能力を行使できない、という新たな現実に直面することになるのです。

   この「先にやった者の勝ち」という「先駆者のルール」の最も典型的な例は領土の獲得でした。15,16世紀の火薬、鉄砲、大砲と大型帆船の力によって始まった大航海時代は、未開の土地、つまり文明化されていない土地として、原住民が居住していても「無人地」(terra nullius)とされ、新たな「発見された土地」として略奪の対象になったのです。 19世紀の蒸気エンジンで海を回る軍艦と大砲で闊歩した帝国主義で欧米の列強は世界の弱き国々を植民地化してきたのです。これらの宗主国は1960年代になって脱植民地化が始まるまで、征服の果実を享受してきたのです。香港が、アヘン戦争以降1842年から1997年まで150年ものあいだ英国領であった、という事実が「先駆者のルール」を如実に証明しているのです。日本がこの「先駆者のルール」の犠牲になったのは、三国干渉に屈して遼東半島を割譲できなかったときに始まり、第一次大戦後のワシントン体制の一翼を担う九カ国条約と四カ国条約で日本のごとく「遅れて来た者」への新たな植民地獲得が禁止されたとき、それと、大東亜戦争に敗れたことにより明治維新以降、国際法上合法的に合意に基ずいて取得した領土さえ獲られたときです。

   経済分野における「保護主義」にしても、「遅れて来た者」の自己防衛の手段であったのです。「公海の自由」や「航海の自由」が慣習法として成立していく過程には、当時のオランダというかつての海洋大国ポルトガルとスペインを凌駕して、世界一の海洋大国の栄冠を手にした強力な海洋国の存在でした。オランダにとって、公海が広ければ広いほど航海・航行の自由が拡大するわけです。その理論付けをしたのが国際法の父といわれるヒューゴー・グロチュウスで、オランダ東インド会社の法律顧問だった人が『海洋の自由』という本を1609年に上梓し、海洋は誰のものではなく、誰もが自由に航海できるものであるべきだ、という主張をしました。 これに対して、オランダよりも海洋国としては少し遅れているイギリスでは海洋の領有権を主張したジョーン・セルドンが『閉ざされた海』を1635年に著しました。つまり弱い国にとって自国が管理できる「領海」が広ければ広いほどその領域内の資源を占有できるからです。現在の国連海洋法条約で規定されている「排他的経済水域」(EEZ)こそが自然資源は眼の前にあるのにも拘わらず、財力も、ノウ・ハウも、技術力も管理能力をも持ち合わせていない「遅れて来た者」が自国の利益を護ろうとする多数の弱小新興国の努力の賜物なのです。EEZは、沿岸より200海里の水域を排他的に沿岸国がその経済的主権を行使するということを法制化したものです。その水域は、水中および海底にいる生物資源に限らず、その海底の地下にある非生物資源をも含みます。それでも、世界最大の海軍力を誇り、世界中の七つの海いたるところにも航空母艦を展開する能力を持つ米国は、この国連海洋条約を未だに批准していなくても別に不便はないのです。 

 「先にやった者」と「遅れて来た者」両者の主張は現在でも本質的に同じような議論が「自由貿易主義者」と「保護貿易主義者」との間で行われています。「持てる国」である「力のある国」と「持たざる国」である「弱い国」との闘争なのです。2001年からカタールのドーハで行われていたWTOの「ドーハ開発ラウンド」という多角的貿易交渉が2008年に決裂した事実が南北問題の難しさを如実に示しています。「弱い国」が「持てる国」の資本、技術、知識などが創り出す時代の流れを塞き止め、逆転させる事はまず無理なのです。WTOの法体制の下では、先進国が産業化・工業化のためにかつて使った手段の多くは現在では禁止されています。19世紀のドイツの経済学者フリードリッヒ・リストによれば、「頂点を極めたものが、他の者が追いつかないようにするために今まで昇るために自分が使っていたはしごをけり倒す」ということは「先にやった者」の姑息な常套手段です。リストは、「これがアダム・スミスの言う全世界主義の秘密である」と断言しました。

 現代の「先にやった者の勝ち」のルールは、核兵器不拡散条約に明示的に現れています。核兵器保有国と核兵器非保有国の間に存在する不平等性を永続するように意図されています。核兵器の「特権」は1967年以前に核兵器を開発した「先駆者」を「核兵器国家」として承認して排他的に保存されているのです。

 以上のような、一連の「先にやった者の勝ち」ルールは、同じように、現在の環境保護や持続的開発の目的の為の規制、気候温暖化防止に関わる一酸化炭素をはじめとする温室効果ガスの排出量の削減、捕鯨禁止などの要求に見られます。そんな要求が口にされる前は、先進国は自由に好きなことをやって来たのです。だからこそ、世界で3番目に排出量が多いインドのモディ首相はCOP21での演説で「先進国は温暖化を招いた歴史的な責任があり、削減の余地も大きい」と指摘したのです。さらに、開発が遅れている国々で作る「後発開発途上国グループ」の議長で、アフリカ南部、アンゴラビセンテ副大統領も「先進国が引き起こした気候変動は私たちの命を脅かしている」と述べているのです。

 とは言ううものの、地球全体を一つの共同体とみなした時、そこに居住・棲息するすべての生物にとって、温暖化がこれ以上悪化することは防がなければならないはずです。その責任は、193か国にもなった国連加盟国のみならず、事実上の〝国家“として、その領土、住民を実効支配・統治している政府も含めてすべての統治機構にあるのです。温室効果ガス排出量削減の負担は、平衡(equity)を200年に亘って温暖化に加担してきた「先にやってきた国」と50年そこそこの期間しか温暖化にかかわっていない途上国との間に求めていかなければならないのです。

 その平衡を打ち出すためにも、先進国から途上国に対して、排出削減に必要な財政支援、技術移転、ノウ・ハウの伝授などの配慮が欠かせないものだと考えます。それと今まで行われてきた温室効果ガスの排出枠の売買をする「排出取引」などは止めるべきであろう。###

米国は、日本では普通イージス艦と呼ばれている誘導ミサイルを搭載している駆逐艦ラッセン」を国際慣習法国連海洋法条約によって認められている公海での「航行の自由」権を行使するために「航行の自由」作戦(FONOP)を実施いたしました。「航行の自由」という権利は公海上のことであり、中国が領有権を主張している南沙諸島にある一つの岩礁を埋め立てて人口の島を造成して、その周辺の海域を中国の領海であるという国際法に違反する主張を認めないという意思表示を行動を以って示したわけです。そのために、中国が領海であると主張する海岸から12海里の海域内に入って航行をしたという発表がありました。

 この「航行の自由」作戦には対潜哨戒機P-8Aポセイドン機とP-3オリオン機を同伴したのです。南沙諸島海域での中国の傍若無人な活動に懸念を表明していた南シナ海の関係諸国は、やっと米国が重い腰を上げて中国の不当な行動をチェックしてくれるものと安堵し、米国の行動を歓迎し、支持したのです。

 ところが駆逐艦ラッセン」の航行の自由権の行使から三日も経たないうちに、「ラッセン」が実際に行なったのは、公海上での「航行の自由」権の行使ではなくて、領海内を航行する「無害通航」権の行使であった、という事実が出てきたのです。「国防ニュース」によると、

 

   「米国海軍筋からの「ラッセン」の通過に関する新たに分かってきた詳細によると、「ラッセン」は合法的な無害通航を行なっているのであり敵対する意図は全くないということを表示する手段を執った、ということです。駆逐艦の発射管制レーダーは作動させておらず、艦載機であるヘリコプターも飛ばせていなかった、と同海軍筋は明らかにしたのです。その付近に飛行していた米国海軍のP-8Aポセイドン対潜哨戒機は海岸から12海里以内の空域に入ることはしなかったのです。」

 

 ここで留意すべき大事なことは、「無害通航」と公海での「航行の自由」というものは全く違う概念であり、それぞれ異なった結果を生じさせるものである、ということです。国際慣習法国連海洋法条約によって規定されている現在の海洋法体制の下では、「無害通航」というものは沿岸国の領海を通航するというすべての主権国家が同等に持つ権利であり、その通航が継続しており迅速に行なわれること、沿岸国の平和、秩序又は安全を害しない限り、無害とされる、と規定されています。また、その通航にはいかなる兵器や艦載機の使用、 調査活動又は測量活動の実施、通航に直接の関係を有しないその他の活動をすることは禁じられているのです。

 したがって、中国人民解放軍海軍艦隊が今年9月始めにアリューシャン列島のベーリング海域の米国の領海を通過したことは、まさに同じことをしたのです。但し、ベーリング海の通過には一つ大きな決定的な差があります。それはベーリング海の領海はどの国からも挑戦を受けておらず疑いなく米国の領海なのです。南沙諸島の主権が南シナ海を巡る多数の係争当事国によって争われているのとは大きな差があります。

 そもそも米国が「航行の自由」作戦にスビー礁を選んだのは、その岩礁が低潮高地のためと、その全部が本土又は島から領海の幅を超える距離にあるため、それ自体の領海を有しないからです。さらにその岩礁を埋め立てて造成された人工島は島としての地位を有しないし、それ自体の領海を持っていないからです。ですから駆逐艦ラッセン」の「航行の自由」作戦の目的はスビー礁の上に埋め立てをして人工島を造成したとしても、最初から領海をもち得ないのですから、そのような中国の一方的な領海の主張は承認しないことを示すところにあります。つまり、スビー礁の周辺の海域は公海である、という前提があります。残念ながら「ラッセン」が成し遂げたことはその逆のようでした。挑発と見られることを避けることに気を配りすぎ、「ラッセン」は公海上での航行の自由権を行使しないことを選んだのです。米国国防省は「ラッセン」が無害通航を行なったことを否定しており、航行の自由権を行使したと主張していますが、その論理が堂々巡りをしているのです。(1)低潮高地であるスビー礁は先ず最初から領海を持たない。(2)無害通航は沿岸国の領海の中でのみ適用されるものであり、スビー礁の周辺海域は公海である。(3)従って、「ラッセン」がスビー礁の12海里以内の海域を通過しても、それは「公海」を通航したのだから、それを「無害通航」とは呼べない、というのです。

 過去には違法な「航行の自由」権の侵害に対して断固として「航行の自由」を行使した事件として、「シドラ湾事件」があります。1973年にリビヤが発表したシドラ湾は閉鎖海でありその海域は「内水」であるという主張に対する「航行の自由」作戦です。そのときの米国の対応の仕方とその状況は今回の事情とは異なりますが、人工島に3000メートルの滑走路を持つ飛行場が完成真近になっているという状況は、シドラ湾の状況よりも深刻な問題を孕んでいるのです。しかし、オバマ大統領が執った中国の非合法な主張に対する対処の仕方は、従来のFONOPとは著しく異なったものでした。 シドラ湾事件では、ロナルド・リーガン大統領は、1981年のFONOPでは。航空母艦二隻を含む艦隊を派遣するというほどに大事に扱われていたのです。

 イージス艦一隻だけを派遣するということは確かに、あえてこれ以上の緊張を高めることは避けたい、という意図が読み取られるのですが、逆にどの国が理不尽な拡張政策を執って、この緊張を高めてきたのかを考えれば、米国の反応は時既に遅きに失し、「航行の自由」という示威行動の内容もあまりにも控えめで、穏便なものであったのです。何故ならば、イージス艦ラッセン」の執った行動は沿岸国の領海を通航するのに要求されている「無害通航」の条件を全て満たして通航する権利を行使したからです。

 「ラッセン」が、無害通航権を実質的に行使した、という事実は、結果として、「ラッセン」の執った行動は、スビー礁の海域は中国の領海であるという中国の主張を、その行動によって受け入れた、ということになります。「ラッセン」は搭載されている自前のヘリコプターを飛ばすことをせずに、対戦レーダーの運転を停止したままで12海里以内の「領海」を通航したのです。まして、「ラッセン」の艦載機ではないP-8Aポセイドン対潜哨戒機も、スビー礁から12海里の領空内に入らずにその空域の外にいた、という事実がこの「航行の自由」作戦の実態を如実に語っています。 端的にいえば、「ラッセン」の航行の自由作戦と呼ばれているものは、名称のみであって、実際の作戦行動自体が明らかに表明したものは、中国の領海であると中国が主張する海域の中を通過する「無害通航」権を行使した、ということなのです。当然のこととして、中国側はこの実態を十分に理解していたはずです。したがって中国外交部の呂・カン(Lu Kang)報道官の発言があまり激しくなかったのも、そのことを表しているようです。呂報道官は、10月27日の通例記者会見で「米海軍艦艇による一連のアクションは、・・・中国の主権と安全保障の利益を脅かすものである。中国側はここに強い不満と反対を表明する」と述べたのです。

 もし実際に「ラッセン」が公海上での「航行の自由」権を行使していたならば、航行の自由権は、国際法で領海では許されない活動であっても、公海上では合法である活動を執行することができたはずなのです。「ラッセン」は、あえて、それをせずに公海上での航行の自由権が与える飛行の自由をも行使しなかったのです。つまり、「ラッセン」は、カーター国防長官が表明したような「どこでも国際法が許すところで飛行し、航行し、行動を執る」ことをしない道を選んだのです。同伴飛行をしていたP-8Aポセイドン対潜哨戒機は、スビー礁の人工島の上空12海里の“領海”と主張される空域には入らない、という選択をしたのです。

 イージス艦ラッセン」の「航行の自由」作戦に纏(まつ)わる一連の出来事に真相はあるようです。(1)前もって「航行の自由」作戦の実施以前に政府筋からリークされた情報、(2)中国人民解放軍海軍への「ラッセン」の行動は中国に対して危害を加えるようなものではなく、中国だけを差別的に対象としていない、ということを伝達していたこと、(3)作戦実行直後、10月29日に持たれた米中海軍トップのテレビ会談、(4) 米海軍太平洋軍司令官ハリス提督の11月2日の北京訪問、そして、(5)その直後、11月7日に行なわれた大西洋での最初の米中合同海軍演習、(6)11月16日の米海軍イージス艦「ステザム」の上海寄港、(7)さらに、『ニューヨーク・タイムズ』紙が報じたように、ホワイト・ハウスの指示として国防関係者に対する「ラッセン」の行動に関する緘口令(かんこうれい)が敷かれていたことなどが、何を示唆しているかといえば、米中の密接な情報交換とそのための交信回路の維持です。同時に、そのことはイージス艦ラッセン」の「航行の自由」作戦には、その台本が在り、それに沿って振り付けがされ、演出されたものだ、という疑いです。

 実際に起きたことは、領海を予告なく通過するという国際法で許される「無害通航」をしたという事実です。米中両国がそのお互いの権利主張を公然と言い合うことは、公海上の「航行の自由」という公に発表された虚構を維持するための「カブキ」興行だった、との印象を避けられないのです。

 「ラッセン」の無害通航以後、11月7日にシンガポールで行なわれた最初のスピーチで、習近平国家主席は、南シナ海の領有権に関して従来通りの主張を自信を持って繰り返しています。「南シナ海の島々は、古代より中国領土であった。中国政府はその領土主権と正当な国益を守る責任を果たさなければならない」と。 さらに、11月22日に、ASEAN 首脳会議で、劉振民中国外交部次官は、平然として「中国は自分の岩礁に必要な軍事防衛施設を建設している。これは多くの国がやっていることだ」と主張したことにも表れている、と考えます。

 以上のような分析が正しいとすれば、米国はスビー礁周辺の海域を領海であるという中国の主張を暗黙のうちに認めたわけです。この「承認」を与えたということが南シナ海のみならず、東アジアの安全保障にどのような変化をもたらすのか少し考えてみましょう。

 (a)米国は今後も同じような「航行の自由」作戦を継続することを言明していますが、このことに関して、米国側は、ちょうど日本の海上保安庁の巡視船が日常茶飯事として中国の海警船による尖閣諸島周辺の領海への日常的な侵入に対して絶えず対峙するように、

中国がこの「新たな正常態」に慣れて来ると考えていることが日本にとって危険なのです。今回の「ラッセン」の無害通航の直接的なインパクトは、尖閣諸島の状況に出てきます。既に11月11日に発覚したように中国は海警船ではなく人民解放軍海軍の艦艇を尖閣諸島海域に出動し始め、その活動もこれから一層厳しくなるはずです。

 (b)「ラッセン」の無害通航は、現在、オランダ・ハーグにある常設仲裁裁判所で争われている南沙諸島を巡るフィリピン対中国の領海問題の今後の展開に不利な影響を与える可能性があります。常設仲裁裁判所はつい先月29日に裁判所の管轄権に関してフィリピンの主張した仲裁裁判所にこの事件を審査する管轄権があるという訴えを受け入れた判決を出しました。フィリピンはこれで、一応第一関門と突破しましたが、これに喜んではいられないのです。この勝利は単にリングに上がれるということだけであり、これから実質内容の審議が11月24日からハーグで始まることになっています。「ラッセン」の無害通航により、米国は中国の領海の主張を暗黙に承認したという情報は多くの人に共有されており、仲裁裁判所の判事の認識にも影響を与えることは避けられないと思います。

 (c)この中国に対するフィリピンの訴訟の成否は、中国の「偉大な中華民族の複興」という「中国の夢」の実現を追求する壮大で、でも醜い、歴史を根拠とした九段線の主張の今後の成り行きを決定させることになるはずです。九段線の主張は、単に南シナ海の航行の自由を脅かすだけではなく、九段線の南に位置する南シナ海とインド洋を結ぶマレー半島スマトラの間にあるマラッカ海峡と、ジャヴァ海とインド洋を結ぶスマトラとジャヴァ島の間を通るスンダ海峡という重要な二つの海峡の使用価値を著しく損なう可能性があるのです。この二つの海峡はインド洋と太平洋を結ぶシーレーンをコントロールする最も重要な戦略地点なのです。さらに、北の方にも、台湾とフィリピンの間を抜けるルソン海峡の中にあるバシー海峡と、沖縄島と宮古島の間にある宮古海峡という二つの重要な海峡が存在します。この北にある二つの海峡を通って中国の人民解放軍海軍は太平洋に進出することができるのです。2010年に初めて中国人民解放軍海軍が宮古海峡を通り抜けました。それ以降、中国海軍の宮古海峡の通過は、太平洋で演習をする中国艦隊にとって毎年恒例の行事になりました。

 バシー海峡中国人民解放軍海軍が日本の監視下にある宮古海峡を通過せずに南シナ海へ戻ることを可能にするものです。中国はこれから次の課題である第二列島線と呼ばれる伊豆諸島から始まり、小笠原諸島マリアナ諸島グアム島カロリン諸島を経てパプア・ニューギニアに繋がる列島に対処しようとしています。

 スビー礁の造成地に飛行場が既に完成真近にあるのは、米国の領土・海域の領有権紛争に関しては中立の立場を貫くという政策方針が、紛争当事国のうち、力の強い側が勝ち残るという結果を許してきたのです。中国のA2/AD(接近阻止・領域拒否)能力が増大している時に、東シナ海南シナ海も中国に実効支配される日も遠く無いのかも知れません。

 アセアン(ASEAN)国防相会議で南シナ海の紛争に対して共同声明が採択されなかったことは、アセアン加盟国間の利害の錯綜のみならず、中国の増大する影響を無視できないことを示しています。中国は、自らが最も好み、得意とする外部者を排除して直接利害関係を持つ者のみを対象にした「一本釣り」をすることにより、その当該国と「二国間交渉」に入ることにより、自国の力を活用するのです。中国の「富」から恩恵を得たいと考える国は多々おります。中国の人民元が、近じかIMFのSDRの構成貨幣の一つとなり国際通貨として認められるはずです。人民元の国際化を世界財源として歓迎すべきなのでしょうが、人民元が国際決済通貨として使用される度合いが増せばますほど中国のブレトン・ウッズ体制への挑戦となります。中国は国際法規範、慣行を無視し、何のおとがめも無く拡張政策を追求しているのです。このような中国の政策は、膨大な陸のシルク・ロードと海のシルク・ロードと言われる「一帯一路」の大計画は「人民元金融圏」の構築への一翼を担うものですし、アジア・インフラ投資銀行は中国の世界覇権掌握のための道具なのです。中国の狙うところは中華世界秩序の構築と朝貢体制を再び復興させることなのです。

 人民元資金供給こそが中国の軍拡の原動力なのは周知の事実です。国際通貨となり、英国の援けもあり、ロンドン・シティーでユーロ・人民元金融市場が出来上がれば、中国の軍拡は益々高まります。米中の軍事バランスは均衡するどころか、米国に不利になるでしょう。そうなる前に米国はその国益を護るために動くはずです。

 その時に、日米関係の重要性が故に、その緊密な関係を維持すること自体が日本外交の目的となるような国益を忘れ、独立国としての主体性を失った外交政策を執った結果、日本の頭越しに米中和解という「ニクソン・ショック」という悲哀と屈辱を二度と味あわないように、備えなければ成らないのです。それは、中国が公然と表明している願望である、「太平洋は米中両国を抱擁しても余るほど広大である」ので、太平洋を東西に二分して、東側は米国が、西側は中国が、それぞれ支配する、という中国が求める米国との「新しい大国関係」がいずれ成立する時に備えなければならないのです。

 「ラッセン」のスビー礁周辺の海域での無害通航は、米中がいずれ共に手を握る前触れだと危惧するのは私だけなのでしょうか。###

The Implications of the USS Lassen’s Innocent Passage

The United States announced that its Navy carried out the Freedom of Navigation Operations (FONOP) within 12 nautical miles of an artificial island built on Subi Reef in the Spratly Islands on October 27, 2015. FONOP was conducted by the USS Lassen, a guided missile destroyer, accompanied by two maritime surveillance aircraft, a P-8A Poseidon and a P-3 Orion. FONOP was to demonstrate that the United States did not recognize China’s unilateral claims of Subi Reef’s territorial sea. The news hit the headlines around the globe. Many people were relieved to know that the Obama administration finally acted on a growing Chinese threat in the South China Sea and supported the United States’ action.

 

The Diplomat remarked with approval on October 28, 2015 that “U.S. allies and partners in the region have now seen evidence that the United States is willing to stand up for the values and principles it has emphasized in diplomatic joint statements for months now. . . . Now that a U.S. grey hull has rejected China’s excessive maritime claims, the security conversations that U.S. diplomats will be having with their counterparts across maritime East Asia will begin on stronger foundations. ” Perhaps, such conclusion was natural at that time.     

 

On October 30, three days after the initial news, however, media, starting with Defense News, carried different stories that what the Lassen conducted was actually “innocent passage” in the territorial sea and not “freedom of navigation” on the high seas. That stark revelation cast the entire the Lassen’s mission into a totally different picture of the control of the South China Sea. According to Defense News,

 

New details about the Lassen’s transit became available Oct. 30 from a US Navy source, who said the warship took steps to indicate it was making a lawful innocent passage with no warlike intent. The ship’s fire control radars were turned off and it flew no helicopters, the source said. Although a US Navy P-8 Poseidon maritime surveillance aircraft was in the area, it did not cross inside the 12 nautical mile limit.  

 

Innocent passage and navigation on the high seas have totally different meanings and carry different consequences. The present law of the sea regime established by customary international law and the UN Convention on the Law of the Sea spells out that “innocent passage” is the right of every state to navigate through the territorial sea of the coastal state so long as a passage satisfies certain conditions such as it being continuous and expeditious, and not prejudicial to the peace, good order or security of the coastal state. Such passage cannot use any weapons, use any aircraft or carry out any survey or undertake any other activity not having a direct bearing on passage.

 

And that right of innocent passage in the territorial sea is precisely what China’s People’s Liberation Army (PLA) Navy fleet exercised in early September this year when it transited U.S. territorial waters in the Bering Sea off the Aleutian Islands. There is one crucial difference in this Bering Sea transit, however. The territorial sea of the Bering Sea is not contested by any state; it is undisputedly the territorial sea of the United States. The sovereignty of the Spratly Islands is disputed by multiple parties of the South China Sea.

 

The choice of Subi Reef for FONOP was deliberately made because the Chinese artificial installation built on a low-tied elevation cannot be subject to territorial sea claims. The purpose of the Lassen’s FONOP was to demonstrate that the rest of the world did not recognize such unilateral declaration of the “territorial sea” of the man-made artificial island on Subi Reef. What the Lassen achieved was the opposite effect. Desirous of avoiding provocation, the Lassen chose not to exercise freedom of navigation on the high seas. The Pentagon denies that the Lassen conducted an innocent passage, and insists that it exercised freedom of navigation. Unfortunately, its argument is circular: (1) a low tide elevation at Subi Reef does not confer any territorial sea rights; (2) innocent passage is only applicable in the territorial sea of the coastal state, but waters of Subi Reef belong to the high seas; and (3) the Lassen’s transit in the waters within 12 nautical miles of Subi Reef, which are part of the high seas, cannot therefore be described as “innocent passage.”

 

The notable recent FONOP was the Gulf of Sidra Incident in 1981 vis-à-vis Libya.

Granted that the Subi Reef situation is somewhat different from Libya’s claims in 1973 that designated the Gulf of Sidra as a closed bay and part of its territorial sea, but with an airport of a 3000-meter runway in near completion on the artificial island on Subi Reef, the situations are more serious than that of the Gulf of Sidra. But President Obama’s response to unlawful claims was a radical departure in form and substance from previous FONOPs. In the Gulf of Sidra, the FONOP sanctioned by then President Ronald Reagan in 1981 had a large naval force led by two aircraft carriers.

 

Dispatching a single destroyer alone must be meant to communicate that the United States did not intend further to heighten growing tensions in the South China Sea. But the paucity of response from the United States, the only sea power capable of dealing with China in the South China Sea, to unlawful activities has allowed China to accomplish what it had intended to do in these reefs of the Spratly Islands. The Lassen’s FONOP took place a little too late, and its operational substance was too modest to demonstrate its professed objective of the action because the Lassen complied with all the conditions attached to the conduct of “innocent passage” in the territorial sea of the coastal state.

 

The fact that the Lassen conducted an “innocent passage” in the end demonstrated by deed its acceptance of China’s claims of the territorial sea of Subi Reef. The Lassen did not fly its helicopters during its transit within 12 nautical miles of Subi Reef installations; nor did the P-8A Poseidon surveillance aircraft that accompanied the Lassen enter the air space above the 12-nautical mile limit. Though they called the Lassen’s mission Freedom of Navigation Operations, it was the name only. Its conduct itself spoke more clearly and loudly. It was an innocent passage within the waters China claims its territorial sea. And China understood it perfectly well. Chinese Foreign Ministry Spokesperson Lu Kang’s statement was rather muted: “Relevant actions by the U.S. naval vessel threatened China’s sovereignty and security interests. . . . The Chinese side hereby expresses strong dissatisfaction and opposition.”

 

If indeed the Lassen exercised freedom of navigation on the high seas, freedom of navigation would have allowed the Lassen to undertake activity that is legitimate on the high seas but not permissible in territorial waters under international law. Freedom of navigation also gives freedom of overflight. The Lassen chose not to “fly, sail, and operate wherever international law allows,” as Secretary of Defense announced. The P-8A Poseidon maritime surveillance aircraft chose to stay out of the air space above the 12 nautical mile of the Subi Reef artificial island. It demonstrated by deed its respect for the territorial boundary of sea and air space of the Subi Reef artificial island.

 

A series of events surrounding the Lassen’s FONOP is noteworthy: (1) pronouncements and leaks made by U.S. officials of the planned “freedom of navigation” operations well in advance; (2) radio communications to the PLA Navy via ----that Lassen’s operations were not harmful nor discriminatory to China; (3) a video conference on October 29 between top U.S. and China naval officers (Chief of Naval Operations, Adm. John Richardson and Commander of the PLA Navy, Adm. Wu Shengli); (4) Commander of the U.S. Pacific Command, Adm. Harry Harris’s visit to Beijing on November 2; and (5) the first U.S.-China joint naval exercise in the Atlantic Ocean on November 7; (6) the USS Stethem’s visit to Shanghai on November 16; and, may I add, (7) the White House’s instructions to Defense officials to be quiet about the Lassen’s FONOP, as reported in The New York Times. They all give the impression that the Lassen’s FONOP was scripted, choreographed and well-staged in the name of “freedom of navigation.” In reality it was the conduct of innocent passage in the territorial sea of the coastal state. Loud verbal exchanges between China and the U.S. asserting their respective rights are just a “Kabuki” performance to maintain the façade of officially pronounced “freedom of navigation” on the high seas. 

 

In the first public speech after the Lassen’s “innocent passage,” President Xi Jinping confidently reiterated in Singapore on November 7 that “islands in the South China Sea have been China’s territory since ancient times, and the Chinese government must take responsibility to safeguard its territorial sovereignty and legitimate interest.” Moreover, on November 22 at the ASEAN Summit in Kuala Lumpur, Mr. Liu Zhernmin, China’s Vice-Minister of the Ministry of Finance, said matter-of-factly, “Building and maintaining necessary military facilities, this is what is required for China’s national defense and for the protection of these islands and reefs.”    

  

Assuming the above analysis is correct, we cannot help concluding that the United States implicitly recognized the territorial sea claims of China in Subi Reef, and we must examine what would be the implications of this “recognition” not only to the security of the South China Sea alone, but also to the East China Sea and beyond.  

  1. The United States expects that China will adjust to “a new normal” just the way Japanese Coast Guard ships have been routinely confronting Chinese Coast Guard vessels’ regular incursions into Japan’s territorial waters of the Senkaku Islands. It is unfortunate that such analogy was drawn between Chinese Coast Guard ships’ violation of the territorial waters of the Senkaku Island and the Lassen’s mission around Subi Reef. The immediate impact will be on the situation of the Senkaku Islands. As already spotted on November 11, China began introducing PLA naval ships, rather than Coast Guard vessels, in the vicinity of the Senkaku Islands. They will be more assertive in their incursions in the territorial waters around the Senkaku Islands.
  2. The Lassen’s innocent passage may adversely affect the future development of the Philippines v. China, an ongoing international arbitration case relating to maritime boundaries in the Spratly Islands before the Permanent Court of Arbitration at The Hague. The Court just issued an award on jurisdiction and admissibility on October 29, 2015 in favor of the Philippines. But victory was only “a go-sign” for the Philippines to enter the ring, where the real fight will take place. The merits phase hearings will start on November 24 at The Hague. As the knowledge of the Lassen’s innocent passage as a tacit U.S. recognition of China’s territorial sea claims is widely shared by many, it may affect the minds of arbitrators on the bench.  
  3. The outcome of the Philippines case against China will most likely determine the fate of China’s grandiose, but grotesque claims of the Nine-dash Line based on      historical grounds in pursuit of “the realization of the Chinese dream of the great national renewal.” Such claims would not only threaten freedom of navigation in the South China Sea, but also potentially jeopardize the use of the most important two straits in the south: the Strait of Malacca between Malay Peninsula and Sumatra, connecting the South China Sea and the Indian Ocean; and the Sunda Straight between Sumatra and Java, connecting the Java Sea and the Indian Ocean. These two straits are strategically the most important controlling points of sea lanes connecting the Indian Ocean and the Pacific Ocean. Also in the north, there are two important straits: the Bashi Channel in the Strait of Luzon between Taiwan and the Philippines; and the Miyako Strait between the Okinawa Island and the Miyako Island. These two straits in the north are for the PLA Navy to access the Pacific Ocean. For the first time in 2010 the PLA Navy transited through the Miyako Strait to the Pacific Ocean. Since then, the passage of the PLA Navy through the Miyako Strait has become an annual event for the Chinese naval exercise in the Pacific Ocean. The Bashi Channel allows the PLA Navy fleet to return to the South China Sea without going back to the Miyako Strait, which is subject to Japanese surveillance. China is now positing itself to deal with the next hurdle, i.e., the Second Island Chain that runs from the Izu Islands through the Bonins Islands, the Marianas Islands, Guam, and the Caroline Islands to Papua New Guinea.

 

With the airport on Subi Reef nearly completed, U.S. policy of being neutral to territorial and maritime disputes has allowed the rule of naked power to prevail. As China increases its A2/AD capabilities, it may not be so far away for the East China Sea and the South China Sea to be effectively controlled by China.

The inability of ASEAN defense ministers meeting to adopt a joint statement on the South China Sea disputes on November 4, 2015 indicates not only the presence of competing and crisscrossing interests among ASEAN member countries, but also a growing Chinese influence. China uses its most preferred mode of “bi-lateral negotiations” between the two parties directly concerned with the issue at stake, rejecting the involvement of any outside parties. China thus deals with one country at a time from the position of strength. Countries want to benefit from China’s riches. China’s Renminbi will soon become an international currency as one of the IMF’s SDR basket currencies. The world should welcome the internationalization of the Renminbi as a source of global liquidity. But China pursues policy of outward expansion with impunity in defiance of international norms and comity.

The more the Renminbi is used as an international settlement currency in terms of frequency and volume, the more it will be considered China’s challenge to the Bretton Woods system. The grandiose vision of “The Silk Road Economic Belt and the 21stCentury Maritime Silk Road” or otherwise known as “the Belt and Road Initiative” was originally announced by President Xi Jinping in pursuit of the “Chinese dream” in the realization of “the great national renewal.” It is designed to create a vast economic zone embracing a new Eurasian economic belt in the north and a new maritime route in the south starting from the eastern seaboard of China through the South China Sea, the Indian Ocean, and Middle Eastern and East African countries to the EU. It is a wing that will sustain the development of “the Renminbi Financial Zone” and the newly established Asian Infrastructure Investment Bank is a vehicle to realize that Chinese dream. What China aims at would be the establishment of China-centric world order with the renewal of its global tributary system.  

It cannot be denied that the funding source of China’s military expansion is the growing supply of the Renminbi. With the internationalization of the Chinese currency together with the opening of the Euro-Renminbi exchange market in the City, London, China’s military power will expands accordingly. And that will eventually tip the balance of power between the United States and China against the former. Before that happens, the United States would make a move to protect its own interest.

We have to be prepared against that eventuality, so that we would not repeat the same fate of being dumbfounded at the United States’ rapprochement with the Communist China in 1971. The so-called Nixon Shock and its resultant humiliation, sorrow, disappointment, and anger at being bypassed by the United States, with which we thought we had a special relationship, taught us a lesson. To maintain the close relationship with the United States cannot be the sole purpose and object of Japan’s foreign policy, but a means to safeguard Japan’s interest. We have to prepare ourselves for the possible U.S. recognition of China’s “major-country relationship with the United States,” which President Xi Jinping has been seeking. It is an open secret that China considers the Pacific Ocean large enough to accommodate the United States and China, the former controlling the eastern half of the Pacific Ocean and the latter controlling the western half of the Ocean.         

Am I the only one who worries that the Lassen’s innocent passage was a prelude to the shaking hands of the United States with China? ###

学界の無責任さ

日本の学界も無責任なものよ。宮沢俊義というお偉い大先生をご存知だろう。

かのお人こそ天皇信奉者といわれ、敗戦直後には明治憲法の改正に反対していたのだ。

その後本人が当時の幣原喜重郎内閣の国務大臣松本蒸治を委員長とする憲法問題調査委員会が発足したのだが、当の松本は商法が専門の東大教授であったため、実際の改正作業は憲法学者の宮沢に委ねられた。その委員会が作成した「私案」というものはことごとくGHQ側から拒否され、「憲法問題調査委員会のメンバーがポツダム宣言を受諾したことの意味、敗戦の意味、民主化の意味をまったく理解していなかった」といわれているのだ。この評価はまさに委員会の作業を指導した宮沢に与えられたものであろう。

 その大先生が敗戦後の新憲法の権威として日本の憲法学の山脈を築いてきたというのだから話にならない。
